All products have been created from perfume fragrances, some of which are famous on the market, inspired by them. Any reference to brands or names is used solely for descriptive purposes to identify the fragrances (ART. 1 bis ex r.d 929/42-IT). The brands and names mentioned here belong to their respective owners. Anyone who purchases a Chogan product therefore acquires an ORIGINAL CHOGAN product!! They are not copies or counterfeits!
ARTICLE 1: SCOPE
These general terms and conditions of sale apply to all sales concluded through the choganparfumluxe.fr website.
ARTICLE 2: ORDERS
Automatic recording systems are deemed to constitute proof of the nature and content of the order. Chogan confirms acceptance of the order to the customer at the email address provided by the customer. The sale shall be concluded upon Chogan's validation of payment for the order, that is, on the date payment is validated for orders paid online by bank card, or on the date payment by cheque is received. In any event, Chogan reserves the right to refuse or cancel any order from a customer with whom there is a dispute relating to payment of a previous order.
ARTICLE 3: AVAILABILITY OF ITEMS
As long as our offers and their prices are visible on the website, they remain valid. The availability indicated when the customer views the website remains subject to the stock status at Chogan and, of course, at the suppliers.
To create our storefront and sales catalogue, we work with databases enriched using information provided by our suppliers. Since this database contains more than one hundred items, not all of them are stored in our warehouses, and our offer is therefore subject to the availability of items from suppliers.
Only the permanent unavailability of an item from our suppliers results in its removal from our sales offer. In other cases, a new order remains possible within a certain period.
When a product ordered is unavailable, the customer is informed by email or on the invoice for the products shipped in the case of an order containing several items.
Order delivery deadline: when the order is placed and on the order acknowledgement, customers are informed of a delivery time. It is calculated by adding the availability period of the product with the longest lead time to the transit time for the transport method selected by the customer.
From the time the order is placed until it is shipped, the customer may cancel the order.
Special cases:
Pre-order items: forthcoming items are offered for pre-order on the choganparfumluxe.fr website. This reservation is made with an announced release date provided by the publisher when the reservation period opens. This release date may be changed at any time by the publisher, which is solely responsible for marketing its product.
In all cases, from the official release date, Chogan endeavours to ship the items to customers who have reserved them, subject to the stock supplied by the publisher for the release day.
ARTICLE 4: PRICES
The prices indicated in euros are net prices, excluding shipping costs. This price includes the price of the products, handling, packaging and storage costs. They may be changed at any time without prior notice, with the understanding that items will be invoiced based on the price in effect when the order is recorded. All orders are invoiced and payable in euros. Any customs duties or local taxes remain the responsibility of the recipient.
ARTICLE 5: SHIPPING COSTS
Shipping costs include a contribution towards preparation, packaging and postage costs. Please remember to group all your items in a single order. We cannot combine two separate orders, and shipping costs will be charged for each one.
ARTICLE 6: PAYMENT
You have several payment methods available, offering maximum security guarantees. You may pay:
- By bank or private payment card (Visa, Eurocard/Mastercard), either directly on the website using the payment form provided during the ordering process (secure entry using SSL encryption), by entering the card type, card number without spaces between the digits, security code (located on the back of the card) and expiry date.
You have various payment methods available and may even benefit from payment facilities by bank card.
Payment is made, at your choice, through the secure banking servers of our partners. This means that no banking information concerning you passes through the choganparfumluxe.fr website.
Payment by bank card is therefore completely secure; your order will be recorded and validated as soon as the bank accepts the payment.
ARTICLE 7: DELIVERY
We deliver to your home or to a pickup point. The delivery time includes the parcel preparation time plus the transit time. Chogan delivers worldwide. The buyer is notified by email of the various stages of order tracking: preparation and delivery.
The delivery time includes preparation and delivery by our carrier. The announced delivery time of 10 to 20 days applies from the time the buyer receives the order delivery email. The delivery time (announced by the carrier) does not in any way bind Chogan to a longer delivery period.
ARTICLE 8: WARRANTY - RETURNS - REFUNDS - RIGHT OF WITHDRAWAL
The items supplied by choganparfumluxe.fr are new and guaranteed against any defect. They are identical to those sold through traditional retail channels and come from all referenced publishers and suppliers.
If an item proves to be defective or non-conforming, the buyer has 15 working days from receipt of the items to request an exchange or refund. If the fifteen (15)-day period normally expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day.
The customer must return the new or unused items in their entirety and in their original packaging, intact, together with any accessories, instructions and documentation (in their original cellophane packaging in all cases and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to choganparfumluxe.contact@gmail.com (description and attached photos).
In the event that the right of withdrawal is exercised, Chogan is required to refund the amounts paid by the customer, free of charge, except for return costs. The refund is due within a maximum of 14 working days from the date the returned parcel(s) is/are received.
Return shipping costs shall therefore remain your responsibility.
In the event of a refund, we guarantee that it will be made within 14 days or less following the date the returned parcel is received. No cash-on-delivery shipment will be accepted, regardless of the reason.
ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISK
Ownership of the products shall transfer to the purchaser only after the price has been paid in full by the purchaser, regardless of the delivery date of the said products. However, the risk of loss of and damage to the products shall transfer upon delivery and receipt of the said products by the purchaser.
ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA
Chogan is the producer and owner of all or part of the databases comprising this website. By accessing this website, the customer acknowledges that the data comprising it are legally protected and undertakes, in particular, not to extract, reuse, store, reproduce, represent or retain, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or any qualitatively or quantitatively substantial part of the content of the databases appearing on the website to which the customer has access.
ARTICLE 11: LIABILITY
The product descriptions in the choganparfumluxe.fr databases were entered based on information provided by the publishers. Chogan is not responsible for the content of the works and shall not incur liability towards the purchaser. Chogan shall not be liable in the event of force majeure (strike, flood, fire, etc.).
The products offered comply with the applicable law of Hong Kong. Chogan accepts no responsibility if the delivered item does not comply with the legislation of the country of delivery (censorship, prohibition of a title or author, etc.). Chogan is not responsible for the content of websites to which hyperlinks from its own website may lead.
ARTICLE 12: APPLICABLE LAW
All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions to which they refer, shall be governed by French law.
ARTICLE 13: ACCEPTANCE BY THE PURCHASER
These general terms and conditions of sale and the prices are expressly approved and accepted by the purchaser, who declares and acknowledges having full knowledge of them and therefore waives the right to rely on any contradictory document, in particular their own general terms and conditions of purchase, the act of purchase constituting acceptance of these general terms and conditions of sale.
